Advocates list gay-welcoming wedding vendors

With Minnesota?s ?first same-sex weddings set for Thursday, supporters and opponents of the new marriage law are busy on very different tracks. Advocates want things to go smoothly on the first day. Businesses that don?t want to serve gay and lesbian weddings continue to look at whether, legally, they can say no.

For vendors eager to serve this new slice of the wedding market, there?s a?website? of welcoming Minnesota wedding vendors.

www.weddingequalitymn.com is a free site where vendors can list their services for gay couples.

?We knew many Minnesota businesses and organizations would want to provide wedding-related services for same-sex couples in Minnesota once weddings started on August 1. So we created an easy way for these groups to let LGBT Minnesotans know that their wedding business is welcome across our state,? said Eric Jensen, communications director for Project 515, which along with OutFront Minnesota helped change Minnesota?s law and build the vendor list.

Jensen said more than 200 businesses, organizations and individuals have posted listings so far.

That?s a more positive spin than this piece in the Colu.mn, a LGBT website, that reminds shoppers which businesses contributed to Minnesota for Marriage, the group that tried to pass a constitutional amendment to ban gay marriage. That measure was defeated by voters last year.

?Same-sex couples might want to avoid holding a reception at Lord Fletcher?s Old Lake Lodge Restaurant in (Spring Park). The owner gave $1,000 to Minnesota for Marriage.? ??Planning a gay wedding in Minnesota? Buy Equality and avoid businesses that might discriminate

Minnesota for Marriage spokesperson Autumn Leva said Friday she wasn?t aware of either effort, but said Minnesota for Marriage has been receiving a lot of inquiries from people in the wedding industry who oppose the new law but can?t legally refuse to serve a gay couple. (Minnesota?s 1993 Human Rights Law guarantees equal protection in public accommodations)

?Businesses are very concerned,? said Leva.? ?They know that there is no protection for them in their ability to live out their beliefs in the way they run their business.?

Leva says a farm owner was approached by a couple who wanted to rent it for their wedding, but Leva can?t provide any specific names of businesses. Minnesota for Marriage is referring them to attorneys at the Alliance Defending Freedom which has filed a lawsuit on behalf of a Washington State florist who refused to sell flowers to a gay customer for his wedding and was sued by that state?s attorney general.

Leva predicts similar litigation will happen? in Minnesota. ?It certainly has proven to be true in every other state that passed same-sex marriage,? said Leva.? ?I?m 100 percent certain that will be the case here in Minnesota as well.?

Leva said Minnesota for Marriage is organizing a forum in October to help people understand the law.

Synta Pharma shares soar after co says to expand breast cancer study

(Reuters) - Synta Pharmaceuticals Corp shares soared as much as 47 percent in heavy trading after the company said preliminary results from a mid-stage study of its drug ganetespib in breast cancer patients supported an expansion of the study.

According to the design of the trial, it would advance to the second stage of enrollment if at least one patient achieved objective tumor response, a measure of reduction in tumor size.

The study, codenamed ENCHANT-1, showed that four patients achieved an objective tumor response.

"We believe these data are important in driving both the potential in multiple tumor types as well as partnering potential," Roth Capital analyst Joseph Pantginis wrote in a client note.

The company said it would continue to enroll up to 33 patients in each of the two patient groups being tested in the study.

The trial will now evaluate a combination of ganetespib and a widely used cancer drug called paclitaxel.

Ganetespib blocks a protein which assists other proteins involved in tumor development and progression in many solid cancers and blood cancers.

The company is also testing the drug in combination with another cancer drug in a late-stage trial for lung cancer. The drug is also being tested in patients with colorectal and blood cancers.

Synta shares were up 35 percent at $6.86 in afternoon trading on the Nasdaq. The stock touched a high of $7.45 earlier.

More than 14 million shares changed hands by 1310 ET, eight times the stock's 10-day average trading volume.

Updated July 28, 2013 15:19:22

Prime Minister Kevin Rudd and his wife Therese Rein have made a surprise visit to Australian troops in Afghanistan.

Mr Rudd visited the Australian base at Tarin Kot in southern Uruzgan province to thank troops for their service.

It was Mr Rudd's fifth visit to the base. His first came a just a week after he was elected prime minister in 2007.

Mr Rudd told the troops that it had been a hard, protracted war and that it was time for them to come home.

"Your mums and dads, your brothers and sisters, your wives and husbands and partners and your kids are all enormously proud of you," he said.

"It's time we brought you home.

"When the flag of Australia is brought down for the last time a few months from now, you will have been?a part of history."

Ms Rein became the first wife of an Australian prime minister to visit a war zone.

She said she was proud to meet some of the soldiers.

"I am really, really proud?to have been able to shake the?hands of some of these amazing?people," Ms Rein said.

Your mums and dads, your brothers and sisters, your wives and husbands and partners, and your kids are all enormously proud of you. It's time we brought you home.

Prime Minister Kevin Rudd

Some of the soldiers said they were excited by Mr Rudd's visit.

"I'm very honoured that he's actually taken the time out of his very busy schedule to come and do that for us, it's fantastic, 100 per cent support from Australia and he represents our country, everything we do, so [it] makes you a very proud Aussie," one said.

By the end of the year, 1,000 of the remaining 1,300 Australian troops will have returned home.

The other 300 will stay as advisers and trainers based in Kabul and Kandahar.

The Tarin Kot base will be gifted to the Afghan National Army.

Forty Australian soldiers have been killed in Afghanistan since 2002.

Pakistan Says Soldier Killed by India Border Firing

by Naharnet Newsdesk 27 July 2013, 09:13 W460

Indian troops shot and killed one Pakistani soldier and injured another in an "unprovoked" attack across the countries' disputed border in Kashmir, Pakistan's army said Saturday.

"A soldier embraced martyrdom while another was seriously injured due to unprovoked firing by Indian troops in Rawala Kot area at the Line of Control (LoC) on Saturday," the army said in a statement.

Kashmir, a Muslim-majority territory, is divided into Indian and Pakistani-administered sectors but is claimed in full by both sides.

It has been the cause of two of three wars between India and Pakistan since independence from Britain in 1947.

A ceasefire has been in force along the Line of Control since 2003 despite sporadic violations on both sides.

WSU offensive coordinator suspended; action stems from violations as Montana coach

OGDEN ? Weber State offensive coordinator Robin Pflugrad has been suspended by the NCAA for one game for violations committed while he was the head coach at Montana.

Pflugrad will not be allowed to coach between Aug. 26 and the end of Weber State?s season opener on Aug. 31 at Stewart Stadium against Stephen F. Austin.

The University of Montana and Pflugrad were penalized for ?failure to monitor the football program,? according to a statement from the NCAA in announcing the sanctions on Friday. The Division I Committee on Infractions found boosters for the Grizzlies ?provided extra benefits to football players, including meals, free legal representation and bail bond payments, a small loan, clothing, lodging, transportation and laundry services. Additionally, the football team exceeded coaching limits and two former student-athletes competed while ineligible.?

The NCAA?s investigation found that Pflugrad was aware that boosters posted bail for two football players but did not report it, while former Montana athletics director Jim O?Day and other senior department members were aware boosters were providing legal assistance.

In addition to the suspension, Pflugrad is restricted from off-campus evaluations this fall, from off-campus recruiting during the first three weeks of the fall and will be required to attend an NCAA rules seminar. Weber State associate head coach Steve Morton will serve as offensive coordinator during Pflugrad?s suspension.

Montana?s penalties include three years of probation, the loss of four scholarships from 2014-17, vacating of five wins from 2011 season in games ineligible athletes played, a $3,000 donation to a local charity, the loss of two student assistant coaching positions this season or next and an external review of Montana?s compliance program.

In 2011, Pflugrad?s second season, the Grizzlies were 11-3 (7-1 Big Sky Conference), tied for the league title and won twice in the FCS playoffs before losing in the semifinal to Sam Houston State.

Weber State football coach Jody Sears hired Pflugrad as offensive coordinator in February after what WSU athletics director Jerry Bovee described as a month-long hiring process.

?(Pflugrad) was very forthcoming to us and honest in his position on (the NCAA investigation),? Bovee said. ?That was the litmus test for us deciding whether he fit in our program.?

Pflugrad provided WSU with copies of his testimony to the NCAA.

?As we looked at it as a collective group with the administration, it felt like (Pflugrad) is a man of integrity, that he may have made some bad decisions, we all make mistakes, but we certainly didn?t see anything as we looked at his situation that gave us any indication that he purposely cheated,? Bovee said.

Pflugrad also said he gave WSU a letter from University of Montana President Royce C. Engstrom stating that there were no improprieties in his performance while at Montana. Pflugrad and O?Day were fired by Engstrom in March 2012.

?My focus was on maintaining the integrity of my football program and never an intent to gain any advantage for myself or any staff members,? Pflugrad said. ?I am ready to do my penalty and get on with football.?

In regard to the NCAA sanctions, Pflugrad said he ?had hoped they?d look at it maybe more humanistically and look at the circumstances and maybe be a little more lenient on the penalties, but that?s their job and I respect that,? he said. ?I?m ready to move on and do my time and learn and grow from it. I did learn a lot through this process.

Pflugrad said the sanctions were ?somewhat of a tough penalty. Failure is a tough word because we never intended to fail in monitoring anything, of course. We had many policies and procedures in place to monitor our players.?

There doesn?t seem to be any grey area in the report, he said, though he felt there were in the situation.

?What constituted a booster was part of the issue ? was it a family member trying to do something proactive in helping a player, is that ultimately a booster?? he said. ?Some of those decisions were difficult. After going through the NCAA investigation, it was proven to me that they were a potential booster and I did learn some things that way.?

The NCAA report says the night two Grizzlies football players were arrested in October 2011, the mother of a student-athlete posted their bail and they each later received an estimated $1,500 worth of legal assistance for free from the mother of an undergraduate student-employee. The Missoulian newspaper has identified the players as Gerald Kemp and Trumaine Johnson.

Pflugrad said the situation was very volatile.

?If you read through the NCAA (report), I did have concerns that there was the possibility of some civil rights violations that did exist,? he said. ?My concern was to control the emotions of my minority players and my minority coaching staff.

?There was never an intent to hide anything from (Montana?s) compliance (department),? Pflugrad said. ?It was just down on the totem pole because of all the other things that were going on with these mitigating circumstances. It was somewhat like a war zone at the time. The minute I knew none of our coaches had bailed players out, I moved on from that.?

Engstrom never offered a public explanation for the dismissals of O?Day and Pflugrad, but the University of Montana was in a tumultuous period where it was investigated not only by the NCAA but by the Department of Justice and the Department of Education for its responses to sexual assault allegations, some of which involved football players.

Pflugrad was fired just days after offering public support for Montana quarterback Jordan Johnson, who was eventually acquitted of a rape charge and has since returned to the team.

The firings came months after the October 2011 incident with Kemp and Trumaine Johnson.

?Really, the investigation had no bearing on my termination as a head football coach,? Pflugrad said, but ?the overall climate and publicity assisted in creating a certain atmosphere in which the administration overreacted and that resulted in the termination of the athletic director and myself as the head coach.?

Fox says Parkinson's won't be focus of NBC comedy

BEVERLY HILLS, Calif. (AP) ? Michael J. Fox says Parkinson's disease will not be a major storyline of his upcoming NBC comedy.

On "The Michael J. Fox Show," the actor plays Mike Henry, a former local NBC newscaster with Parkinson's, who left the business to spend more time with his family. The series begins when he decides to return to work now that his kids are older.

At Saturday's Television Critics Association summer press tour, Fox said he didn't think about how others with Parkinson's would react to the show because he doesn't "vet creative instinct."

"I just go with it," he said. "I feel that this is the reflection of my experience and certainly in the pilot it was more prevalent than it is in subsequent scripts. The way I look at life and the reality of Parkinson's, sometimes it's frustrating and sometimes it's funny. I need to look at it that way and other people need to look at it that way. Beyond that we all got our own bag of hammers...I think people will look at that and say, 'Yeah, I need to laugh at my own stuff, too.'"

The premise of the show does have similarities to Fox's real-life story. The actor left "Spin City" in 2000 as he tried different treatments and medications to treat Parkinson's. He also used the opportunity to spend quality time with his four kids during their formative years.

"There's kind of a scrutiny of their stuff that won't exist if I'm being occupied by something else," joked Fox of the distraction of a full-time job.

Fox believes the viewers, however, will not be distracted by his character having Parkinson's on his new series.

"Parkinson's itself there's nothing horrifying to me. It's not horrible. I don't think it's gothic nastiness. There's nothing on the surface horrible about someone with shaking hands."

Since leaving "Spin City," Fox has had recurring roles on shows like "Rescue Me" and "The Good Wife." Those guest spots gave him the itch to do more.

"It really brought me to a place of, 'This is what I do,'" he said. "This is what I was built and programmed to do, and so I wanted to do it. It's what I've loved to do...I thought, 'Why can't I? There's no reason not to do it.'"

Because Fox plays a local NBC newscaster, the show will tap real people to do guest appearances that make the story more believable. Matt Lauer and Savannah Guthrie are in the pilot. New Jersey governor Chris Christie will appear in an episode as himself.

"A fictional television network didn't give us 22 episodes," Will Gluck, executive producer, said jokingly on why they decided to make Fox's Mike Henry work for NBC.

The Michael J. Fox Show" premieres Sept. 26 at 9 p.m. EST/PST.

Ariel Castro pleads guilty in kidnappings, agrees to life sentence without parole

At his court hearing, Ohio kidnapper Ariel Castro said he understood he would never be released from prison under the terms of his plea agreement and added, "I knew I was pretty much going to get the book thrown at me."

By Erin McClam, Staff Writer, NBC News

Ariel Castro, the Cleveland man accused of imprisoning and raping three women for a decade, pleaded guilty Friday and agreed to serve life without parole ? sparing the city an agonizing trial and perhaps the women from reliving their nightmare on the witness stand.

Under a plea agreement outlined in court, Castro agreed to a life sentence plus 1,000 years. The deal allows him to avoid the death penalty and forestalls a trial that was scheduled to start in two weeks.

?I knew I was going to get pretty much the book thrown at me,? Castro told Judge Michael J. Russo of Cuyahoga County court in Ohio. Asked whether he knew that he was forfeiting any hope of getting out of prison before he dies, Castro said: ?I don?t think there?s any reason.?

Castro, 53, was accused of abducting the women from the Cleveland streets between 2002 and 2004, then holding them in his home for a decade. Investigators say he raped and impregnated them and sometimes chained them in the basement. Castro fathered a daughter, now 6, with Berry, authorities have said.

Under the plea deal, Castro must also forfeit the modest home that prosecutors said he turned into a horror house. Prosecutors said the county planned to tear it down soon. Castro will be formally sentenced later at a hearing in which the three women will have the chance to address him.

The three ? Amanda Berry, Gina DeJesus and Michelle Knight ? escaped in May after Berry broke partway through a door and screamed for help while Castro was out of the house. Lawyers for the women say they simply want the matter behind them.

Castro faced 977 criminal counts, including attempted murder, a charge brought by Ohio prosecutors after one of the women told investigators that Castro forced her to miscarry by punching her in the stomach. Forty of those counts were either dropped Friday or merged into others.

He had pleaded not guilty July 17 at a hearing in which the judge had to ask him to keep his eyes open. Prosecutors said they were considering the death penalty but never announced a decision.

The women broke their silence in a three-minute video July 9. In it, Knight said: ?I may have been through hell and back, but I am strong enough to walk through hell with a smile on my face, and my head held high, and my feet firmly on the ground.?

Castro, who has been held on $8 million bail, appeared in an orange prison suit for the hearing Friday. He also wore glasses in court for the first time, and told the judge they helped.

Castro and Russo, the judge, engaged in a lengthy question-and-answer designed to make sure Castro understood the plea agreement. When Russo asked him about a criminal count that classified him as a sexually violent predator, he answered: ?The violent part I don?t agree with, but yes.?

Ford's Transit van factory in Southampton closes - @BBCNews

Staff at Ford's Transit van factory in Southampton have finished their final shifts as it prepares to close its doors later.

More than 500 workers were based at the Swaythling plant, which has produced two million Transits over 40 years.

Production is moving to Turkey, where costs are "significantly lower" than in western Europe, according to Ford.

Ford says its former factory workers have all taken redeployment, voluntary redundancy or early retirement.

A new ?12m vehicle distribution centre is being created at Southampton docks, while a vehicle refurbishment plant at the existing site will provide positions for 134 staff.

A further 750 jobs have been affected by the closure of the tool and stamping operation in Dagenham. They have also either accepted redundancy, early retirement or been redeployed within the company.

'Ghost town'

Unions had called the closures a "betrayal" when they were announced last year.

More than 4,000 people once worked at the Ford factory in Southampton

One worker said the backbone of Britain" had gone with the closure of the plant.

Mark Radcliffe, who has worked at the factory for nine years, will continue to work for Ford at its new site in Bridgend, despite being "Southampton born and bred".

He said: "It's a quite eerie feeling, it's all very quiet. It's like a ghost town in there now.

"It's the end of an era, but the future is bright for some and Ford will continue and I'm looking forward to the future with Ford Motor Company."

Alan Merritt, who is taking redundancy, said he believed the plant had been "earmarked for closure" for 15 years.

"I'm out of a job. They say it's voluntary redundancy but I don't see it being voluntary."

However, Rick Ranson, who is moving to the engine plant in Bridgend, South Wales, after 25 years at the Southampton Transit factory, said he believed his co-workers taking redundancy "would be fine".

"It's quite sad really, people have been coming here day in, day out for 25 years, some of them 30 years.

"But, they're a good bunch of guys and I'm not worried for them at all."

Study: Taller women associated with greater cancer risk | The Raw ...

By Reuters
Thursday, July 25, 2013 13:37 EDT

?

By Laura Zuckerman

(Reuters) ? Women?s chances of developing cancer after menopause increase with their height, according to a new study.

Among nearly 145,000 women between the ages of 50 and 79, researchers found that height was more strongly associated with cancer than such established risk factors as obesity.

The association held true for everything from thyroid cancer to melanoma, researchers reported in the latest issue of Cancer Epidemiology, Biomarkers and Prevention, a journal of the American Association for Cancer Research.

It?s not height itself that?s the risk factor, though. The authors of the new study say height ?should be thought of as a marker for one or more exposures that influence cancer risk, rather than a risk factor itself.?

?There?s an intriguing indication that things going on in early life appear to feed into a process that may increase the risk for various cancers,? said Geoffrey Kabat, lead author of the study and a senior epidemiologist at Albert Einstein College of Medicine of Yeshiva University in New York.

Those things might include diet as well as hormones in the body that contribute to normal growth, although researchers aren?t sure yet.

Cancer involves the uncontrolled division of abnormal cells in processes having to do with growth, so it follows that hormones or other growth factors that influence height may also influence cancer risk, Kabat said in a telephone interview with Reuters.

Dr. Walter Willett, chair of the department of nutrition at the Harvard School of Public Health, said the study should not raise alarm for the tall, though it does provide additional evidence that greater height is associated with cancer.

?The increase in risk is modest and is balanced by a lower risk of cardiovascular disease in taller people, so there is no reason for those of us who are tall to panic,? Willett, who was not involved in the study, said in an email. ?Most importantly, research to understand the reason for the extra risk in taller people may lead us to new ways to prevent or treat cancer.?

ISOLATING THE LINK TO HEIGHT

The postmenopausal women in the study were participants in the Women?s Health Initiative, a 15-year research program established in 1991 by the National Institutes of Health and other agencies to address the most common causes of death, disability and poor quality of life in postmenopausal women.

Altogether the researchers tracked 144,701 women for an average of 12 years, during which 20,928 of them developed new cancers.

Even after adjusting for such factors as body mass index ? a ratio of weight in relation to height ? the women?s risk of developing any cancer rose by 13 percent for every 10-centimeter increase in height (about 4 inches), the researchers say.

With every extra 10 centimeters, researchers found, women?s risk for cancers of the kidney, rectum, thyroid or blood rose by 23 to 29 percent, and their risk of melanoma and cancers of the breast, ovary, endometrium or colon rose by 13 to 17 percent.

According to the American Cancer Society, the average woman?s lifetime risk of cancer is 38.2 percent.

Other large studies have identified an association between height and certain cancers, but most of those studies didn?t rule out the influence of other factors.

Kabat and his colleagues say they took more than a dozen potential risk factors into account ? including age, use of oral contraceptives, smoking history, alcohol intake, age at their first menstrual period, and education ? and they still found that women?s height was linked to their cancer risk.

?At this point it seems to be a plausible mechanism whereby early nutrition could affect growth and cancer,? Kabat said.

For example, tallness is tied to greater consumption of milk proteins by rapidly growing pre-pubescent girls, and in some studies milk intake has been linked with higher levels of a certain protein that may play a role in some of the abnormal cellular processes seen in cancers.

?It is also possible that the larger organ size and skin surface area associated with greater height may put more cells at risk of being transformed to malignancies,? Kabat said.

Two previous studies reported that the correlation between height and any type of cancer was stronger among women who had never smoked, but Kabat and his colleagues found the correlation did not differ by smoking level.

Review of Jalape?o's Grill | TableCritic

By Rachel Lebeaux -?Jalape?o?s Grill opened in Walpole in 2006 in a small space with only five tables. A year and a half later, the establishment moved down the street and expanded ? from 18 seats to 150.

?I want to bring authentic food,? says owner Ricardo Dorronsoro, who hails from Cancun and says that many of the restaurant?s recipes are his mother?s. These authentic eats include enchiladas, chiles rellenos and mole. ?Ask any Mexican, and they?ll know what you?re talking about,? he said.

Jalape?o Grill

You?ll also find some familiar Mexican and Tex-Mex creations. ?I can?t get away from burritos ? people expect them,? Dorronsoro says with a laugh. Everything is made from scratch or sourced from Mexican providers, he adds.

Jalape?o?s has separate bar and restaurant sections, both expansive. The bar is more sparsely decorated, but is bright and boasts a pool table and televisions. On the restaurant side, the walls are adorned with photography and artwork depicting Mexican scenes. There are also mariachi-dancer figurines, Mexican skull art and fancy tequila bottles, their contents begging to be sampled. Bright colors wash over the plates and bowls; the same lively hues are reflected in the upholstery of the heavy wooden chairs. Spanish-language music is an upbeat soundtrack to the meal.

Jalape?o?s Dining Area

Dorronsoro says he prefers to station himself in back of the restaurant, overseeing the kitchen and checking on the food as it comes out. But he also serves drinks and meals and interacts with his customers. How does he want these guests to perceive his establishment?

?Just sit down, take off your shoes and relax,? he says. ?If you?re in a rush, you?re in the wrong place.?

Drinks:??A few years ago, vodka was booming. Now, tequila is booming,? Dorronsoro says. As such, he offers dozens of varieties, served both straight up and in myriad cocktail configurations.

My house special margaritawasn?t cheap at $13, but it was presented in a giant glass ? a bowl, really, rimmed with salt. It mingled Jose Cuervo Platino, Grand Marnier, homemade sour mix, lime juice and orange juice. Served on the rocks, the drink was quite strong but went down smooth, and thankfully wasn?t drowning in sugary flavorings, which is too often the case with restaurant margaritas.

House Special Margarita

?Ricardo?s Famous? Red Sangria

One of the evening?s specials was white sangria with peaches. It was tempting, but we opted for the popular ?Ricardo?s famous? red sangria ($5.95/glass). Served in a wine goblet, the sangria didn?t have any fruit in it, but the drink was soft, cinnamon-scented and refreshing, with a beautiful fuchsia color.

Appetizers:?After the complimentary chips and pico de gallo ? diced tomato, white onion, cilantro and jalapeno peppers ? we dove into the shrimp ceviche($12.50), which tossed that pico de gallo with chilled, diced shrimp marinated in lime juice, topping the mixture with

chips and pico de gallo

slivers of avocado. Arranged in a goblet and accented by salted corn chips, the ceviche was light and flavorful.

The menu didn?t indicate that the sopa de mariscos(bowl $6.99, cup $5.99) would be spicy, but it was, and it really hit the spot. The fishy broth, seasoned with chili powder, contained generous lumps of lobster meat, tilapia, swordfish, shrimp and potatoes.

sopa de mariscos

Entrees:?You have your choice of fajita fillings at Jalapeno?s; we ordered chicken and steak?($18.99). The grilled meats were served on a sizzling cast-iron platter on a bed of onions and peppers. On the side came the standard fajita fillings: shredded lettuce and cheese, pico de gallo, sour cream, black beans, Spanish rice and flour tortillas to wrap it all up in; for $1, we added guacamole. The fajitas were good, although we felt they could have been more seasoned; the menu encourages guests to request spicier food if they wish, and I would probably do so next time. In the interim, the bottled?green habanero sauce on the table did the trick.

Chicken and Steak Fajitas

?

The enchiladas con salsa roja($12.99), served with a side of black beans and rice, were covered with onions, tomato, cilantro, cheese and a dollop of sour cream. They could have used more salsa and cheese, but the flavors were there. The enchiladas were stuffed with a generous portion of shredded chicken, which we found a little watery; it again benefitted from a shot of habanero sauce to bring the whole dish together.

The pescado achiote tacos ($14.99) ? described on the menu as ?one of the most popular dishes in the Yucat?n peninsula? ? featured a nice-sized filet of grilled tilapia on each taco wrapped in a double layer of corn tortillas. The Spanish rice went well, although the vegetables of the day, spinach and mushrooms, needed more seasoning.? The Mexican slaw and tomatoes atop the tilapia gave the tacos a very pleasant sweetness.

Dessert:?We considered ordering the fried ice cream, but settled on the tres leches cake($6). The yellow sponge cake, soaked in evaporated, condensed and whole milk, was very sweet, slathered with vanilla frosting and sprinkled with cinnamon.

Tres Leches Cake

Assessment:?Jalape?o?s Grill offers well-executed versions of both the Mexican and Tex-Mex dishes you know and also some you don?t. If you like your food spicy, don?t be afraid to ask the kitchen to kick the heat level of your dishes up a few notches. And heed Dorronsoro advice: relax and have a good time. The drinks are tasty, and the large, festive dining areas are perfect for groups looking for a fun night out.

Google

The new Nexus 7 tablet will be available July 30, with pricing starting at $229 for a 16 GB, Wi-Fi only model.

Google unveiled a brand new Nexus 7 tablet, Android 4.3, and Chromecast, a tiny device that gets video content from phones and computers onto TVs, during an event in San Francisco on Wednesday.

"Today, we are going to talk about two things," Sundar Pichai ? senior vice president of Android, Chrome and Apps ? said as the event began. The first is a new Android device, the second, a new Chrome device.

The new Nexus 7 and Android 4.3
Pichai turned the stage over to Hugo Barra, vice president of Android product management, for the Android portion of Wednesday's announcement. Barra explained that the new Nexus 7 is a few millimeters thinner and narrower than the prior model. "It's a much more comfortable grip," he said.

The new 7-inch tablet has a better screen as well. It has gone from offering 1,280-by-800 pixels in the prior model to 1,920-by-1,200 pixels in the new one and from 216 pixels per inch (ppi) to 323 ppi. The RAM jumps from 1GB to 2 GB. The tablet has a 1.2-megapixel camera in the front and a 5-megapixel camera in the back. The new Nexus 7 will be available in three flavors: A 16GB Wi-Fi-only model for $229, a 32GB Wi-Fi-only model for $269 and a 32GB LTE-capable model for $349.

The new tablet, available July 30, will ship with Android 4.3, the newest version of Jelly Bean. While Android 4.2 introduced multi-user functionalities, Android 4.3 adds "Restricted Profiles." This feature allows apps to be restricted on a user level so that apps can behave differently based on the active user. Android 4.3 will also support Bluetooth Smart, which is a low-energy Bluetooth standard.

While Android 4.3 will ship with the new Nexus 7, it will be pushed out to the last-generation Nexus 7, Nexus 4, and Galaxy Nexus beginning on Wednesday. The HTC One and Samsung S4 which are sold with the "Nexus Experience" will receive Android 4.3 at a later time.

Chromecast costs $35 and works with your home's Wi-Fi network.

Chromecast
"The average household has three televisions," Pichai said, adding that many users struggle to get video content from their phones, tablets and laptops to their televisions. Google's solution to this problem is called Chromecast. Unsurprisingly, it's based on Chrome.

Chromecast is a small dongle which you plug into your television's HDMI input in order to push content from your phone, tablet, or computer.

Just open up YouTube, for example, and you'll find a new "Cast" button that'll get things started. You'll be able to push content, adjust the volume and more right from your phone. (And yes, you'll even have a "Cast" button on the iOS version of the YouTube app, not just on its Android counterpart.) Other apps, such as Netflix, Google Play Movies, Google Play Music and Pandora will also offer support for Chromecast.

You can seamlessly switch between controlling your television from various devices ? be they phones, tablets, or laptops ? instantly. This means that you're not suddenly going to lose control of a movie if the person who pushed it to your TV happens to leave the room.

The Chromecast dongle is priced at $35 and comes with three months of Netflix access. It can be ordered beginning on Wednesday.

Verizon's three new Droid devices: Thin, long-lasting, and compact

Your gadgets

Droid

Rosa Golijan / NBC News

Verizon and Motorola unveiled the refreshed Droid smartphone line at an event in New York City on Tuesday. The three new devices focus on three different concepts: Thinness, battery life, and compactness.

While introducing the new smartphones, Rick Osterloch, Motorola Mobility's senior vice president of product management, emphasized that all three have significant upgrades over the last generation of Droid devices. He listed off a 24 percent faster CPU, a 100 percent faster GPU, and twice the RAM. All three have 2-megapixel cameras in the front and 10-megapixel cameras in the back. Lovers of Google Now will be happy to find that they can control the virtual assistant by saying "OK, Google Now" and issuing a command. (Yes, the "OK, Google Now" trigger phrase will be familiar to Google Glass fans.) Those who are used to super-high-resolution screens might not be all that excited though: The new Droid devices offer 720p displays. This is a bit disappointing when dealing with the tall Ultra.

The new Droid Ultra will be priced at $199. It will focus on thinness. It's a thin, tall, beast of a phone which will be available in red of black. It has a 1.7 GHz dual-core processor with quad-core graphics, 2 GB of RAM, and 16 GB of storage. Unlike the MAXX and Mini, the Ultra does not support wireless charging .(Which is not surprising considering that it's only 7.18 millimeters thick.)

The new Droid MAXX will be priced at $299 and focus on battery life. It is 9 percent thinner than last year's Droid MAXX model, measuring in at 8.5 millimeters. It has a 1.7 GHz dual-core processor with quad-core graphics, 2 GB of RAM, and 32 GB of storage. According to its spec sheet, it will handle up to 48 hours of use on a charge.

Droid

Rosa Golijan / NBC News

The Droid Mini is priced at $99 and is "compact without compromise," the folks from Motorola explain. It has a 4.3-inch display and sits in one's hand as comfortably as an iPhone (which will make Android users who favor the smaller footprint quite happy, even if it isn't quite as slender). It has a 1.7 GHz dual-core processor with quad-core graphics 2 GB of RAM, and 16 GB of storage.

Pre-orders begin online on Tuesday and the devices will start shipping on Aug. 20. Early purchasers, those who order one of the new Droid devices before Sept. 30, will receive 6 months of free Google Music Play All Access service. Access to Ingress, a location-based invitation-only game made by the folks in Google's Niantic Labs, is also included (along with the ability to invite 5 friends).

While you're making notes on your calendar, keep in mind that the Moto X, that other new Motorola device, will be officially unveiled on Aug. 1. Leaks suggest that the gadget might just be the mid-rage smartphone to beat and that it might bring a more "pure" Android experience.

Verizon makes the Droid Ultra, Droid MAXX and Droid Mini official

DROOOIIIIIDDDDDDD

Verizon's 2013 Motorola Droid lineup

Verizon has unwrapped it's new Motorola Droid line, bringing the US the first Motorola Droids of 2013. They look to be real winners, sporting thin bodies, new designs, and an all-new Motorola X8 Mobile Computing System. Think of the eight cores on the device -- two for apps, four for graphics, one contextual and one for natural language -- working together to bring us an all-new experience.

First up, the Droid Ultra. Built with a Kevlar body and 3D design, it's the thinnest smartphone available. Following is the Droid MAXX, also built of Kevlar and 9-percent thinner than last year's model yet still delivers 48-hours of battery life (up from last years 32 hours). The Droid Mini offers the same great software in a more compact size.

All three phones offer some interesting software enhancements, including an Active Display that keeps notifications on the screen without turning everything on, Quick Capture to take fast pictures, Droid Zap -- share photos with anyone within 300 feet of you with a two-finger gesture, and the Droid Command center for Miracast support.

Pricing is as follows: The Mini checks in at $99, the Ultra at $199, and the MAXX at $299. These prices are with a new agreement, of course. The devices will be available on August 20, and pre-orders start now today at 1PM ET at droiddoes.com.

Purchasers will also receive an Ingress invite, and six months of free Google Play Music All Access.

We're heading over to the devices to have a good look -- keep an eye out. In the meantime, a gallery of pictures of the event and the official press release is past the break.

University Hospitals study shows poor quality sleep linked to poor skin health, faster aging

CLEVELAND, Ohio -- A study released on Monday by University Hospitals Case Medical Center and Est?e Lauder Companies Inc. shows that people who don?t get enough sleep at night are more likely to have poorer skin health and skin that ages more quickly.

Preliminary results? of the clinical trial, which took place at UH?s Skin Study Center in 2012 and was paid for by Est?e Lauder, were originally shared at the International Investigative Dermatology Meeting in Edinburgh, Scotland in May.

Researchers say the study is the first to conclusively demonstrate the link between lack of sleep and skin damage.

We all know that constant all-nighters for school or work leaves us looking haggard the next morning. And more and more evidence is showing that a good night?s sleep is essential for our health. Skimp on it and you?re at risk for high blood pressure, gaining weight. If you don?t get good quality sleep, you could be susceptible to metabolic diseases, gastrointestinal orders and other conditions.

With an interest in seeing if lack of sleep damages one?s skin, Est?e Lauder?s research division turned to UH.

Sixty women, all pre-menopausal between ages 30-49, were in one of two groups ? good sleepers and poor sleepers (those getting less than five or fewer hours), as measured by the Pittsburgh Sleep Quality Index.

Among the study results:

*The intrinsic age score (natural aging) for poor quality sleepers was twice as high as that for good sleepers. The higher the age, the more evidence of fine lines, loss of facial skin elasticity and other signs of aging.

*While there wasn?t any significant difference in the two groups in terms of extrinsic aging (damage to the skin from external factors such as smoking and the sun), the skin of good quality sleepers recovered more quickly from environmental stressors to the skin such as sunburn.

*Poor sleepers showed a higher rate of water loss in the skin, an indication that the skin?s ability to act as a barrier may be damaged.

Not surprisingly, the women who got enough sleep had a better self image than their sleepy counterparts. Of the study participants, poor quality sleepers were more likely than good quality sleepers to be obese (44 percent vs 23 percent).

?We think that poor sleepers are holding onto inflammation a lot longer,? said Dr. Elma Baron, director of UH?s Skin Study Center and the principal investigator of the study.

?We want that skin to be restored.?

Baron, who also is associate professor of dermatology at Case Western Reserve University School of Medicine, has collaborated with Est?e Lauder on previous skin studies.

?We don?t know how long it would take before someone?s [skin] can recover from [the damage caused by] being a poor sleeper,? Baron said. ?We definitely want to restore the skin health. We just don?t know how long it would take for these physiological changes.?

When asked what new products are being developed based on the findings at UH, Est?e Lauder?s executive director of global research and development-skin biology declined to provide details.

?Over the years we have become an expert in products that help remove internal damage in the cells,? said Dr. Nadine Pernodet. ?We?re going to do more related research.?

Moody's upgrades Sprint's Debt Ratings Following Softbank Takeover

Published on:

?Moody's Investors Service has upgraded several ratings of Sprint debt ratings following the closing of the merger agreement with SoftBank, and a separate merger agreement with Clearwire.

SoftBank, with an issuer rating of Ba1, acquired a 78% stake in Sprint, a transaction valued at $21.6 billion. Moody's believes that the merger with SoftBank will help Sprint to improve its operating performance in the highly competitive US wireless industry due to the infusion of $5 billion of new equity capital and SoftBank's track record of operational turnarounds of wireless companies in Japan (increasing market share and expanding margins). The merger with Clearwire, a company with a vast holding of spectrum, addresses Sprint's spectrum needs for at least the next several years.

Sprint's Ba3 Corporate Family Rating recognizes its large scale, its valuable spectrum assets, slowly improving operating profile, substantial liquidity, and the implicit support from Sprint's parent company and majority shareholder, SoftBank. Offsetting these strengths are high leverage, weak margins, and our projection for negative free cash flow through 2015. Near flawless execution across all aspects of the business, including the requirement to quickly redesign and modernize its entire network will be necessary before Sprint can hope to grow its market share in the brutally competitive US wireless industry.

Sprint and SoftBank will look to quickly maximize synergies after the closing of the deal. Reducing operating expenses will be crucial to successfully executing a financial turnaround. Combined, Sprint and SoftBank are expected to have the third largest position in terms of smartphones sold in the Japan and United States. With this scale, the company should be able to order larger numbers of smartphones at lower prices than they pay today. SoftBank has a proven track record and significant expertise in the wireless industry and will look to maximize network efficiency in order to reduce network operating expenses, reduce Information Technology-related costs, and improve churn as Network Vision is further deployed. Capital efficiency should also be realized due to the combined company's larger scale and Sprint's enhanced spectrum portfolio following the closing of the Clearwire deal. SoftBank believes that a 32-36% reduction in capital spending through synergies can eventually be achieved. SoftBank is experienced with managing heavy wireless traffic, building and deploying TDD-LTE technology and building out and maximizing core capacity at cell towers.

Wireless data demand is driving up spectrum needs for carriers as well as the perceived value of spectrum. Suffice to say, Sprint was facing a spectrum shortfall issue and the company's acquisition of Clearwire addresses spectrum needs for at least the next several years to support future growth. Clearwire's vast spectrum holdings in the 2.5 GHz band provides Sprint with tremendous depth and a platform for differentiation. With the expertise and guidance from SoftBank, we anticipate Sprint will leverage its 2.5 GHz spectrum capacity to achieve sustainable competitive speeds on its network.

In order for Sprint to reach its target goal of 200 million POPs covered by 4G LTE by year-end 2013 and complete Network Vision, capital spending will remain highly elevated through 2014. The company has publicly stated that it plans to spend a total of $16 billion in capital in 2013 and 2014. Moody's expects capital spending to decline to about $6 billion (unadjusted) annually after 2014. Sprint and Clearwire had a little over $8 billion of cash at the end of the 1Q 2013. Capital spending totaled almost $1.5 billion during the quarter. Sprint was scheduled to receive about $2 billion of new equity capital from SoftBank when their transaction closed and was expected to spend about $4 billion to purchase the shares of Clearwire that it didn't already own. High capital spending, modest revenue growth and low EBITDA margins supports Moody's projection for negative free cash flow through 2015. We project over $10 billion of cumulative negative free cash flow through 2015. Moody's expects Sprint will raise additional capital, either by going to market or receiving additional funding by SoftBank, to address its cash needs over the next few years.

Moody's believes that Sprint is currently at a significant competitive disadvantage to Verizon and AT&T since the two largest US wireless carriers have much larger LTE coverage today, an increasingly important factor behind subscriber provider decisions. Also, Verizon and AT&T have recently intensified their efforts to gain prepaid subscribers (a customer set the companies did not focus on previously) which makes up about one-third of Sprint's retail subscriber base. In addition, T-Mobile USA recently came out with some aggressive service pricing plans and a new program called JUMP, which allows customers to upgrade their phones up to twice a year. However, Sprint, along with T-Mobile USA, still have the benefit over Verizon and AT&T of offering unlimited data plans (albeit with weaker current LTE coverage compared to Verizon and AT&T). Unlimited data plans also run the risk of restraining future margin expansion at the expense of retaining customers as the demand for wireless data will continue to increase.

The ratings for the debt instruments reflect both the overall probability of default of Sprint, to which Moody's assigns a PDR of Ba3-PD, and the loss given default assessments of individual debt instruments.

Sprint's $3.0 billion unsecured credit facility is rated Baa3 (LGD2 - 14%). The three-notch lift from the Ba3 CFR reflects the structural seniority provided by the guarantees from the operating subsidiaries of Sprint. Sprint's Senior Unsecured Notes are rated B1 (LGD5 - 74%) and Sprint's Junior Guaranteed Unsecured Notes are rated Ba2 (LGD3 - 37%). The Ba2 rating assigned to Sprint's Junior Guaranteed Unsecured Notes reflects its seniority ahead of Sprint's Senior Unsecured Notes, and its subordinate ranking to the Senior Unsecured Guaranteed Bank Credit Facility.

The B1 (LGD5 - 74%) rating for Sprint's subsidiary, Sprint Capital, reflects the guarantees from the parent on a senior unsecured basis. The senior secured 2nd priority notes of Sprint's subsidiary, iPCS Inc., are rated B1 (LGD5 - 74%) and is secured solely with the underlying assets of iPCS. Moody's rates Clearwire's senior secured 1st lien notes and senior secured 2nd lien notes Baa3 (LGD1 -- 1%) and Baa3 (LGD1 -- 2%), respectively, three notches above the Ba3 CFR due to their priority claim and significant loss protection. The 1st lien notes are secured by substantially all of Clearwire's domestic assets, and are guaranteed, on a joint and several basis, by all domestic operating subsidiaries. Reflected in our LGD analysis is Moody's expectation that Sprint will likely redeem $2.947 billion of Clearwire's 1st lien notes due 2015 within the next 12 months and refinance the debt at Sprint's parent level. Moody's also ranks the company's $1.0 billion secured equipment credit facility ahead of the unsecured credit facility and pari passu to Clearwire's 1st lien notes.

The stable outlook reflects our belief that operational performance (churn, subscriber trends, market share) will improve and that operating synergies will be achieved enabling slow, but steady margin expansion. The stable outlook also incorporates an expectation that the Network Vision project will remain on schedule and will produce the expected benefits.

Sprint's ratings could be raised if its turnaround accelerates. Specifically, if leverage were likely to drop below 4.0x, and free cash flow were to turn positive rating pressure would ensue (note that all cited financial metrics are referenced on a Moody's adjusted basis).

Sprint's ratings could be lowered if the network upgrade falls behind schedule or doesn't yield the financial and operational benefits promised or if Sprint's competitive position deteriorates as evidenced by postpaid CDMA churn rising (outside of normal quarterly variances) or overall market share declines. Also, if the company allows its liquidity position to weaken significantly, negative rating pressure will ensue. Specifically, if leverage was likely to exceed 6.0x (Moody's adjusted) on a sustained basis, the ratings could be downgraded.

Attorneys Trade Jabs Over Suit Against NCAA Pending In Oakland Fed Court

Attorneys trade jabs over suit against NCAA

INDIANAPOLIS (AP) One day after six current college football players joined a closely watched antitrust case against the NCAA, attorneys on both sides swapped fresh jabs Friday.

Current and former athletes believe they are owed billions of dollars, saying the NCAA allowed their likenesses to be used in video games without compensation. NCAA chief legal counsel Donald Remy made it clear Friday that the governing body has no intention of changing the amateurism policy that has been a bedrock principle since the NCAA was founded more than a century ago.

"College sports today are valued by the student-athletes who compete and all of us who support them," he said. "However, the plaintiffs' lawyers in the likeness case now want to make this about professionalizing a few current student-athletes to the detriment of all others. Their scheme to pay a small number of student-athletes threatens college sports as we know it.

"In particular, we would lose the very real opportunity for at least 96 percent of NCAA male and female student-athletes who do not compete in Division I men's basketball or FBS football to play a sport and get an education, as they do today."

Former UCLA basketball star Ed O'Bannon is the lead plaintiff among 16 former college athletes in the lawsuit. Basketball Hall of Famers Bill Russell and Oscar Robertson previously joined the lawsuit that also named video-game maker EA Sports and the Collegiate Licensing Co. A federal judge is considering a request to grant class-action status to the lawsuit, which would open it to potentially thousands of current and former athletes and possibly expose the NCAA to millions in damages.

Besides voluminous court filings, there have been plenty of twists.

On Wednesday, the NCAA issued a statement saying it would no longer allow EA Sports to use its name or logo on video games. The NCAA had been being paid $545,000 annually by EA Sports.

A day later, six current players - Vanderbilt linebacker Chase Garnham; Clemson cornerback Darius Robinson; linebacker Jake Fischer and kicker Jake Smith from Arizona; and tight end Moses Alipate and wide receiver Victor Keise of Minnesota - were added to the list of plaintiffs.

O'Bannon's side insists the flurry of movement this week indicates the NCAA is worried it might lose in court.

"It's apparent to us that the NCAA's decision to end its long and hugely profitable relationship with EA is tied directly to the pressure our litigation is bringing the bear," said Steve Berman, the lead counsel for the plaintiffs and managing partner at Hagens Berman. "Our suit illustrates how the cabal between the NCAA and EA has exploited student athletes for years, using their images in video games without compensation. While we are heartened they've stopped the practice, we believe they owe those student-athletes a great deal more than their implied promise to stop stealing their images."
